WARRANTIES are valid only if products are assembled and installed in accordance with manufactures instructions. Products not specifically noted above are Warrantied for one (1) year. Warranties are void if products have not been properly maintained, show signs of abuse, vandalism, neglect or misuse, or have been modified without the approval of American Playground Corporation®.The above warranties do not cover cosmetic damage due to normal wear. However, excessive wear may be covered solely at American Playground's discretion. American Playground Corporation® shall not be responsible for the cost of any transportation, labor for removal of equipment, nor for the labor cost of reinstallation of replaced or repaired products. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR USE. TERMS: Payment is due prior to shipment. Institutional buyers are eligible for Net 30 Days with approved credit. A service charge of 1.5% per month is added for past due accounts. Title to all goods passes to the customer at the time payment is made. SHIPPING CHARGES: Unless other arrangements are made, shipping and handling is paid by American Playground and added to the customer’s invoice. LOSSES IN TRANSIT: All products are packaged in new condition and given to the carrier for delivery to the customer. It is the customers’ responsibility to ensure |
that the products received are still in an undamaged condition. The customer must examine the shipment for damage and verification of the count. Any discrepancies must be noted on the Freight Bill before it is signed. American Playground will not be responsible for any Freight Bills signed “Free and Clear”. Please call us if you have any questions about damage or counts. TAXES: Applicable taxes will be added to the invoice unless a tax exempt certificate has been provided.
